Terms of Service

1. Who you are contracting with

These Terms of Service ("Terms") form a binding agreement between you and Jonathan Wheaton, the seller and operator of the Echoes From the Ancestors™ platform ("Echoes From the Ancestors", "we", "us"). By creating an account, accessing, or using the service, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. Who can use Echoes From the Ancestors

You must be at least 18 years old, or the age of majority where you live, to create an account. If you are using the service on behalf of an organization or family group, you confirm you have authority to bind that group to these Terms.

3. The service

Echoes From the Ancestors is a digital platform for creating, preserving, and sharing voice, video, photo, and written stories ("Echoes") and scheduled future deliveries ("Future Echoes™") inside private Echo Vaults shared with family members you invite.

4. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it updated.

5. Acceptable use

You must not misuse the service. In particular, you must not:

  • Use Echoes From the Ancestors for any unlawful, fraudulent, or harmful purpose.
  • Upload content that infringes intellectual property rights, depicts illegal activity, or contains malware.
  • Send spam, harvest data, or impersonate another person.
  • Probe, scan, or interfere with the security or integrity of the service, or attempt to bypass any technical limits, rate limits, or access controls.
  • Reverse engineer, resell, or redistribute the service.

6. Your content

You retain ownership of the Echoes you create. You grant us a limited, worldwide, non-exclusive license to host, store, transmit, transcode, and display your content solely so we can provide the service to you and to the family members you invite to your Echo Vault.

7. Our intellectual property

The service — including its software, design, branding, "Echoes From the Ancestors™", "Future Echoes™", "Echo Vault™", and related marks — is owned by Jonathan Wheaton and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you have purchased.

8. Payments and merchant of record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's Buyer Terms govern payment, billing, currency, taxes (including VAT/sales tax), cancellations, and refund mechanics. By purchasing a plan, you also agree to those terms.

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. Lifetime plans are one-time purchases.

10. Cancellation and what happens to your Echoes

You can cancel a paid plan at any time. Honoring our trust promise, your Echoes are never deleted when you cancel — your Echo Vault simply becomes read-only at the end of your paid period, and you can reactivate at any time to resume creating new Echoes.

11. Suspension and termination

We may suspend or terminate your access to the service if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or repeatedly or seriously violate our acceptable use rules. Where reasonable, we will give you notice and an opportunity to cure.

12. Service level and warranty disclaimer

We work hard to keep Echoes From the Ancestors available and reliable, but we do not guarantee that the service will be uninterrupted, error-free, or perfectly secure. To the fullest extent permitted by law, the service is provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to these Terms or the service is limited to the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for any indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.

14. Indemnity

You agree to indemnify and hold harmless Jonathan Wheaton and Echoes From the Ancestors from any third-party claim arising out of your content, your use of the service in violation of these Terms, or your violation of applicable law.

15. Governing law

These Terms are governed by the laws of the United States and the state of Jonathan Wheaton's principal place of business, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction, unless mandatory consumer protection law in your country of residence grants you the right to bring proceedings locally.

16. Changes

We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date and, where appropriate, notified to you by email.
